LIABILITY WAIVER, RELEASE OF CLAIMS, ASSUMPTION OF RISK & PARENTAL CONSENT

IMPORTANT: PLEASE READ CAREFULLY BEFORE SIGNING. THIS AGREEMENT INCLUDES A RELEASE OF LIABILITY FOR CLAIMS ARISING FROM THE RELEASED PARTIES' OWN ORDINARY NEGLIGENCE AND MAY AFFECT YOUR LEGAL RIGHTS.

All individuals participating in Black Outside Skate must complete this agreement before entering the skating rink. Participants under 18 must have a parent or legal guardian complete the applicable consent provisions on their behalf.

1. Event and Facility Responsibilities

Black Outside Skate is a voluntary recreational skating activity offered during Black Outside Fest 2026, organized by Black Makers Market.

Millennium Youth Entertainment Complex operates and supervises the skating rink, including rink operations, facility safety procedures, and skating equipment provided by the facility.

Black Makers Market serves as the event organizer and does not operate, maintain, or directly supervise the skating rink.

For purposes of this agreement, "Released Parties" means Black Makers Market, including its directors, officers, employees, volunteers, agents, and authorized representatives.

2. Acknowledgment and Assumption of Risk

I understand that roller skating is a recreational physical activity involving inherent risks, including but not limited to:

• Slips, trips, falls, and loss of balance.

• Collisions with other skaters, objects, or rink structures.

• Injuries caused by skating equipment or improper equipment use.

• Injuries resulting from the actions or omissions of other participants.

• Sprains, fractures, head injuries, permanent disability, or death.

I understand that injuries may occur even when reasonable safety precautions are followed.

I voluntarily choose to participate in Black Outside Skate and knowingly assume the inherent risks associated with roller skating, whether known or unknown, to the fullest extent permitted by Texas law.

3. EXPRESS RELEASE OF LIABILITY FOR ORDINARY NEGLIGENCE — ADULT PARTICIPANTS

I, AS AN ADULT PARTICIPANT, EXPRESSLY RELEASE, WAIVE, AND DISCHARGE THE RELEASED PARTIES FROM ANY AND ALL CLAIMS, DEMANDS, CAUSES OF ACTION, DAMAGES, LOSSES, OR LIABILITIES ARISING OUT OF OR RELATED TO MY PARTICIPATION IN BLACK OUTSIDE SKATE, INCLUDING CLAIMS FOR PERSONAL INJURY, DEATH, OR PROPERTY DAMAGE CAUSED IN WHOLE OR IN PART BY THE RELEASED PARTIES' OWN ORDINARY NEGLIGENCE.

THIS RELEASE EXPRESSLY INCLUDES CLAIMS ARISING FROM THE ORDINARY NEGLIGENCE OF BLACK MAKERS MARKET OR ANY OTHER RELEASED PARTY IN CONNECTION WITH EVENT ORGANIZATION, RINK OPERATIONS, SKATING SUPERVISION, INSTRUCTION, EQUIPMENT, INSPECTION, MAINTENANCE, OR OTHER RELATED ACTIVITIES.

I UNDERSTAND THAT THIS AGREEMENT IS INTENDED TO RELEASE CLAIMS ARISING FROM THE RELEASED PARTIES' OWN ORDINARY NEGLIGENCE, EVEN IF THAT NEGLIGENCE CONTRIBUTES TO AN INJURY.

This release applies only to claims that may lawfully be released under Texas law and does not extend to conduct or claims for which liability cannot legally be waived.

4. PARENTAL CONSENT AND RELEASE OF PARENT'S CLAIMS

If I am signing on behalf of a participant under 18 years of age, I certify that I am the minor's parent or legal guardian and have the authority to authorize participation.

I voluntarily authorize the minor participant(s) identified below to participate in Black Outside Skate and acknowledge the inherent risks associated with roller skating.

TO THE FULLEST EXTENT PERMITTED BY TEXAS LAW, I EXPRESSLY RELEASE AND WAIVE MY OWN CLAIMS AGAINST THE RELEASED PARTIES ARISING FROM THE MINOR'S PARTICIPATION, INCLUDING MY OWN CLAIMS FOR DAMAGES, LOSSES, OR EXPENSES CAUSED IN WHOLE OR IN PART BY THE RELEASED PARTIES' OWN ORDINARY NEGLIGENCE.

TO THE EXTENT I HAVE LEGAL AUTHORITY TO DO SO, I ALSO INTEND TO RELEASE CLAIMS ON BEHALF OF THE MINOR PARTICIPANT, INCLUDING CLAIMS ARISING FROM THE RELEASED PARTIES' OWN ORDINARY NEGLIGENCE.

I understand that Texas law may limit a parent's authority to waive a minor's independent personal-injury claims and that this agreement does not eliminate rights that cannot lawfully be waived.

I agree to ensure that the minor participant(s) understand and follow the skating facility's safety rules and instructions.

5. Participant Safety Requirements

I agree that I, and any minor participant(s) for whom I am responsible, will:

• Follow all posted rink rules and instructions from facility staff and authorized event personnel.

• Skate responsibly and at a speed appropriate for individual skating ability.

• Avoid reckless behavior, pushing, racing, intentional collisions, or conduct that endangers others.

• Use skating equipment appropriately and report damaged or unsafe equipment.

• Immediately report injuries or unsafe conditions to rink staff.

• Stop skating if injured, unwell, or unable to participate safely.

• Leave the skating area when directed by authorized personnel for safety reasons.

I understand that failure to follow safety requirements may result in removal from the skating activity.

6. Emergency Medical Assistance

In the event of an injury or medical emergency, I authorize event personnel to contact emergency medical services when reasonably necessary.

I understand that any resulting medical expenses may be my responsibility or that of the minor participant's parent or legal guardian, subject to applicable law.

7. Governing Law and Severability

This agreement shall be interpreted in accordance with the laws of the State of Texas.

If any provision of this agreement is determined to be invalid or unenforceable, the remaining provisions shall remain in effect to the extent permitted by law.

Nothing in this agreement is intended to release claims or waive rights that cannot lawfully be released or waived.

8. Voluntary Agreement and Electronic Signature

By signing this agreement, I acknowledge and confirm that:

• I have carefully read and understand this entire agreement.

• I understand the inherent risks associated with roller skating.

• I understand that this agreement contains an express release of liability for the Released Parties' own ordinary negligence.

• I voluntarily accept the terms applicable to me.

• If signing as a parent or legal guardian, I authorize the minor participant(s) identified below to participate.

• I understand that participation is conditional upon completion of this agreement and compliance with applicable safety rules.

All skating participants must complete this agreement below before entering the rink.
